  • Website Visitors: The only personal information we collect directly via our website is when a visitor voluntarily subscribes to our newsletter. This includes name and email address.
  • Consulting Services: As part of our client engagements, we may receive personal data about client employees for the purpose of conducting workforce analytics, including using this data within our MeritSoft Suite of tools. In these cases, we act as a data processor, and the client remains the data controller.

We apply reasonable and appropriate administrative, technical, and physical safeguards to protect the confidentiality, integrity, and availability of personal data. This includes:

  • Use of secure tools for processing client workforce data
  • Restricted access to data on a need-to-know basis

3. Legal Basis for Processing and Consent

We rely on the following legal bases:

  • Contractual Necessity or Legitimate Interest: For consulting services, we process client-provided data to fulfill contractual obligations and deliver agreed-upon services.

If you withdraw your consent or request erasure of your personal data:

  • For newsletter subscribers, we will remove your information from our mailing list and systems.
  • For workforce data provided by clients, the data controller (our client) is responsible for fulfilling such requests. We will assist them in doing so per our data processing agreement.

We honor all rights afforded under applicable laws, including:

  • Right to access, correct, or delete your personal data
  • Right to withdraw consent at any time
  • Right to data portability
  • Right to object to certain processing
  • Right to lodge a complaint with a supervisory authority

5. Consequences of Not Providing Data

  • For newsletter subscriptions: If you do not provide an email address, you will not be able to receive our updates or communications.
  • For client-provided data: Failure to provide sufficient workforce data may limit the accuracy or completeness of our consulting analyses.

6. Data Governance and Roles

Privacy and data protection oversight is the responsibility of:

  • Chief Operating Officer – Accountable for policy enforcement, annual review, and breach response.
  • All Employees and Contractors – Required to follow our documented privacy procedures and report any concerns.

7. Data Request Handling Procedures

We follow defined, documented procedures for responding to data subject requests and client (controller) instructions. This includes:

  • Logging all requests
  • Confirming identity
  • Responding within statutory timeframes
  • Coordinating with data controllers where applicable

These procedures are documented in our internal information security and privacy protocols and communicated to relevant personnel.

8. Data Retention

  • Newsletter data is retained until you unsubscribe or remain inactive for 24 months.
  • Client data is retained as contractually agreed.

9. Policy Review
